1. Conditions of purchase
THIS AGREEMENT APPLIES TO YOUR PURCHASE OF PRODUCTS FROM G. DOYON CUISINE INC. (“Doyon Després”) THROUGH THE WEBSITE https://www.doyondespres.com/ (the “website”). READ IT CAREFULLY. UPON PLACING AN ORDER TO PURCHASE PRODUCTS ON THE WEBSITE OF DOYON DESPRÉS(“products”), YOU WILL AGREE TO THESE TERMS, WHICH WILL CONSTITUTE A VALID AND BINDING AGREEMENT (the “Agreement”).
2. E-mail
When you shop on the website or when you send us emails, you communicate with us. You hereby agree to the electronic exchange of information and documents between you and Doyon Després on the Internet or by e-mail. We will communicate with you by e-mail or by posting notices on the website. You acknowledge that this agreement and any other agreement, notice and other communications in an electronic format are the equivalent of an original contract written on paper.
3. Content
You acknowledge that all content on the website, such as the texts, the graphic elements, the logos, the trademarks, the software, the icons, the illustrations, the audio clips, the digital downloads and the data compilations (the “content”) — including the way the content is presented or appears — and all related information, is owned by Doyon Després or its suppliers. You acknowledge that you acquire no ownership rights by visiting the website or purchasing products.
4. Authorization and access to the website
Doyon Després gives you a limited access to the website and allows you to make a personal use of it, without, however, allowing you to download (except to store some pages) or modify it, even partially, unless you received a specific written permission from Doyon Després. This authorization excludes: the resale or commercial use of the website and/or content; the use of any lists of products, descriptions or prices for commercial purposes; any derivative of the website or its content; any downloads or copies of account information for the profit of another merchant, and any use of search tools, collection tools and data extraction tools. Neither the website nor the content may be reproduced, in whole or in part, copied, sold, resold, visited, or exploited for any commercial purpose without a specific written permission from Doyon Després. You are not authorized to frame the content without a specific written permission from Doyon Després. You are not authorized to use the meta tags or any other “hidden text” using the name or trademarks of Doyon Després without a specific written permission from Doyon Cuisine. Any unauthorized use terminates the permission, or authorization granted by Doyon Després if applicable. Doyon Després grants you a limited, revocable, and non-exclusive right to create a hyperlink referring to the homepage of the website, provided that this link does not present Doyon Després, its affiliated companies, their products or services in a false, misleading, defamatory or otherwise offensive manner. You cannot use any logos nor any other exclusive graphic signs or Doyon Després trademarks without a specific written permission from Doyon Després.
5. Your account
If you use the website, you are responsible for maintaining the confidentiality of your account and password, and to restrict access to your computer. You agree to assume responsibility for all transactions made in your account using your password. Doyon Després reserves the right, in its sole discretion, to refuse to serve a client, to close an account, to remove or change the content of the website, or to cancel an order.
6. Product description
Doyon Després is doing everything in its power to ensure the utmost accuracy on the website. However, Doyon Després does not guarantee that the product descriptions and/or the content are always accurate, complete, reliable, updated or free from error. To the extent provided by law, Doyon Després reserves the right to: (1) correct any errors, inaccuracies or omissions at any time without prior notice or liability towards you or anyone else; (2) change at any time the products and services offered for sale on the website — including the prices, the fees, the descriptions and the specifications of those products and services, the promotional offers and any other content on the website without prior notice or liability towards you or anyone else; (3) cancel, eliminate or not process an order (including an accepted order) if the price or any other important information on the website is inaccurate; and (4) limit quantities offered for sale or already sold.
7. Hyperlinks
Hypertext links contained on the website may refer to other websites. As Doyon Després cannot control these websites and external sources, you acknowledge that Doyon Després cannot be held responsible for the availability of these websites and external sources, and cannot bear responsibility for the content, the advertisements, the products, the services, or any other material available on or from these external websites. In addition, you acknowledge that Doyon Després cannot be held responsible for any damage or alleged or demonstrated loss, nor for any connection with the use of the content on these websites or external sources or the fact of having trusted the content, the goods or the services available on these sites or external sources.
Finally, to the extent provided by law, Doyon Després cannot be held responsible in the case where the content of those other websites would contravene the existing legal and statutory provisions.
8. Product prices
The prices of the products displayed on the website are in Canadian dollars.
The prices are subject to change without notice. The products and services are always charged based on the current rates at the time of the online purchase.
The transportation and delivery costs and any sales taxes applicable under both provincial and federal tax legislation will be added to the price of the product.
9. Terms of payment
The following methods of payment are accepted on the website:

• Mastercard
For security reasons and to prevent fraud, all purchases made by credit card on the website will only be accepted if the name and billing address match the name on the credit card of the buyer and the address in his or her credit card record. If the information does not match, your order will be denied, even if the operation has been pre-authorized by your financial institution. In this case, we will not give the final authorization of payment and you will not be charged for the transaction.
10. Financing
The financing service provided by EconoLease is available to customers purchasing regularly priced products, clearance products and used products valued at $ 1,000 or more.
The monthly payments offered by EconoLease are based on a 36-month term. The suggested amount does not include taxes, shipping costs or installation costs.
This financing plan is only valid for established businesses. Contact us for more information about an agreement that can be made for a new business.
11. Delivery
We process each order within 1 to 3 business days. Once the order is processed, it is usually delivered by Canada Post within 2 to 5 business days. Delivery time cannot be guaranteed during peak periods.
We assume the risks of the loss of the ordered products until you take possession of the parcel at the shipping address provided.
We recommend you to carefully inspect the products on arrival and to write down all comments concerning the damages that may have occurred during the delivery. Any claim related to the damages caused during transportation or delivery must be addressed to the carrier, as Doyon Després does not take any responsibility in this regard.
12. Warranty
The products ordered are covered by the manufacturer warranty.
13. Return
You have 30 days following delivery to return your order. The refund will be made via the same method of payment used in the transaction. The item must be returned in its original packaging, unused and in perfect condition with all documentation, additional parts and accessories.
14. Limitation of liability
TO THE EXTENT PROVIDED BY LAW, DOYON DESPRÉS CANNOT BE HELD RESPONSIBLE BY A CLIENT FOR: (I) ALL SPECIAL, INCIDENTAL, CONSEQUENTIAL, COLLATERAL, OR PUNITIVE DAMAGES (EVEN IF DOYON CUISINE WAS NOTIFIED OF THE POSSIBLE OCCURRENCE OF THIS TYPE OF DAMAGE) RESULTING FROM THE OPERATION OR NON-OPERATION OF PRODUCTS OR OTHER TERMS OF THE RELATED CONTRACT (INCLUDING DAMAGES CAUSED BY THIRD PARTIES), SUCH AS, BUT NOT LIMITED TO, LOSS OF REVENUE OR EXPECTED PROFITS, OR ANY LOSS AS A RESULT OF THE INTERRUPTION OF ACTIVITIES; OR (II) ANY AMOUNT EXCEEDING THE PRICE OF THE PRODUCT PURCHASED. THE CLIENT ACKNOWLEDGES THAT THIS LIMITATION OF LIABILITY IS A DETERMINING FACTOR IN THE PRICING OF THE PRODUCT AND THAT THE ACCEPTANCE OF THIS LIMITATION OF LIABILITY IS A FAIR ALLOCATION OF RISKS.
15. Changes to the terms and conditions
We reserve the right to make changes at any time to these conditions of purchase. Any changes or revisions will come into force as soon as they are displayed on the website, and by purchasing products on the website after the posting of these changes, you agree to the new terms.
16. Privacy
We are committed to protect and respect the privacy of our customers and website visitors. Therefore, we take all measures to our disposition to protect your personal datas obtained on our website and via our communications.
